PRESENTAZIONE DELL’EVENTO
I cinquant’anni trascorsi dall’introduzione della legge sul divorzio inducono ad una riflessione, allo scopo di valutare quanto sia cambiato nella società da allora ad oggi e in quale misura ciò si sia riflesso nel diritto di famiglia a livello sia di ulteriori interventi legislativi che di giurisprudenza. È indubbiamente facile osservare che in questo lungo periodo si è notevolmente ampliato l’affrancamento della donna dai compiti domestici e della cura dei figli mentre, al contempo, è aumentata nettamente la sua equiparazione all’uomo in tutte le funzioni sociali. Parallelamente e comprensibilmente la riforma delle norme sull’affidamento introdotta nel 2006 avrebbe potuto e dovuto sigillare questo processo e favorirne il completamento, atteso che questo non si è ancora interamente compiuto. Tale evento, tuttavia, dal quale ci si attendeva una decisiva rottura tra presente e passato per quanto riguarda i rapporti fra genitori e figli non sembra aver dato luogo agli effetti sperati. Il riavvicinamento tra il concreto evolversi dei rapporti sociali e l’evoluzione della giurisprudenza secondo alcuni non si sarebbe verificato, se non sotto l’aspetto nominalistico. L’appuntamento con le pari opportunità tra uomini e donne all’interno della famiglia separata appare ad alcuni completamente mancato anche perché il messaggio della legge sul divorzio, che sicuramente andava nella direzione di una parità di aspettative per il mondo femminile rispetto a quello maschile, non sarebbe stato raccolto. Conclusioni che, tuttavia, non sono condivise da tutti, mantenendo ferma la convinzione buona parte del sistema legale che per realizzare al meglio l’interesse dei figli non esista tuttora assetto più idoneo ed efficace di una netta separazione di ruoli, delegando alla madre i compiti di cura dei figli e lasciando al padre quello di provvedere alle risorse materiali per soddisfarne i bisogni. Allo stesso modo è stato faticoso, e tuttora non compiuto, il tentativo di liberare la moglie divorziata da una dipendenza morale e materiale dal suo passato accanto al marito, mediante l’erogazione di assegni che tengano conto del tenore di vita goduto in costanza di matrimonio, ritenendo sufficiente, e per lei stessa preferibile, fare a meno del soccorso altrui quando possa assicurarsi con le stesse proprie risorse quanto basta per una vita dignitosa, a prescindere dai precedenti; mentre altri continuano a ritenere assolutamente corretta e doverosa la tradizionale erogazione, in nome del principio di solidarietà.
È apparso, pertanto, di notevole interesse riassumere le spinte che hanno portato alla riforma del 1970, mettendole accanto all’ulteriore evoluzione sociale e al contempo sottoporre ad analisi i principali aspetti della vita della famiglia separata che rappresentano, allora come oggi, le principali spine di conflittualità interne alla famiglia separata. Ciò sempre in passaggi a due voci, che metteranno a confronto di volta in volta il punto di vista maschile e femminile, lo psicologo e il giurista, il riformista e il conservatore.
